TERM AND CONDITIONS

1. All orders are to include item code, product description, quantity, price and freight and handling charges (see below).
2. Orders may be placed by phone, fax, mail or e-mail. Please quote your order number and payment details.

IMPORTANT NOTE FOR FACE MASKS PURCHASES

Due to the outbreak of Swine Influenza A (H1N1), there has been an unexpected high demand for face masks in recent times. As a community service, Livingstone International maintains a high level of inventory of most popular products to meet sudden surge in demand. Please contact our sales department for specific pricing and availability. Due to hygiene reasons, all face masks sales are final, and Livingstone International will not be accepting any returns, exchanges or refunds of all face masks orders, as permitted by law.

Terms and Methods of Payment

1. All website orders must be paid by VISA, MasterCard or Bankcard.
2. The cost of recovering any default of payments will be borne by the customer. Court in NSW has sole jurisdiction.
3. The goods remain property of Livingstone International Pty Ltd until full payment is received.
4. Insurance is always the responsibility of the overseas customers; we do not insure export consignments.

Prices

1. Prices are negotiable for bulk requirements. Please contact our sales department.
2. Prices are quoted in Australian dollars.
3. Prices are subject to change without prior notice.
4. We reserve the right to rectify prices quoted in the invoice, if found to be incorrect.

First Time User (FTU) Price

1. Valid for a limited time and for qualifying customers only.
2. FTU prices are intended only for items never purchased before, and for sampling purposes only.
3. First Time User (FTU) price offer is applicable only upon customer’s request at the time of ordering, and not automatically or retrospectively applied.
4. FTU prices can be used once only. Regular prices will apply on repeat orders.
5. Where FTU unit price is less than $100/unit, the FTU quantity is limited to $100 per item; where FTU price is over $100/unit, the FTU quantity is limited to one unit. Our normal Terms and Conditions apply.
6. FTU price offer may NOT be used in conjunction with any other offer including free shipping, gift offers, bundle deals or/and any other active offer for the same item.
7. The company reserves the right to amend and/or discontinue the FTU price for any item to any customer without prior notice.

FREE $50 LIV Voucher

1. This offer is exclusive to new customers and other customers whose last purchase was over six (6) months ago.
2. Single-receipt purchase of at least $300 Ex GST is entitled to a free voucher.
3. Only one voucher per customer for this promotion.
4. Voucher serial numbers will be printed on customers’ invoice which must be quoted for future redemption.
5. Voucher can be used on customers’ next purchase of any item/product from Livingstone with minimum worth of $300 Ex GST.
6. Voucher is valid for two (2) months from the date of invoice or issuance.
7. In the event of any dispute, the decision of Livingstone is final.

Availability and Brands

1. Common types and sizes are usually available in stock. Unpopular products types and sizes will require minimum 4-6 weeks delivery time.
2. We endeavour to stock all items displayed in this catalogue at all times. However due to unforeseen or unexpected circumstances there is always a possibility that we may temporarily run out of stock of a particular stock item. We will exercise our discretion and supply an alternative brand of comparable quality to save you the convenience of back ordering.
3. If back ordered item is no longer required, please advise our after sales service.

Delivery and Freight

1. In Australia, freight handling and insurance charges are calculated based on post code and order value.
   1. Charges are as follows:
      Metro Freight ranges from $5.50 - $27.50 depending on order size and weight
      Regional Freight ranges from $8.80 - $44.00 depending on order size and weight
      Country Additional fuel surcharge may apply (dependant on post code? please refer to pdf document)
   2. Price are inclusive of GST.
   3. All orders over 10kg will be subject to additional freight charges.
   4. Goods will not be delivered until payment is made to Livingstone except trade account customers.
   5. Upon receiving Cheque, 3 working days clearance must be allocated before order is released.
   6. All orders may be subject to minimum handling fees of $3.85 (Inc. GST).

2. For overseas delivery, customers will be informed the freight cost by email, and the customer must approve the freight charge by email or fax before delivery.

Return of Goods Policy

1. Returning Goods
   1. Prior approval must be obtained from our after sales staff on 1300 556 556 or email our sales department before returning goods.
   2. A Return Authority Number (R.A.N.) form will be sent to you once the return is authorised. The form is to be attached with goods together with a copy of our delivery docket/invoice and any other relevant correspondence.
   3. Goods returned must be in their original packaging.
   4. Any claim for incorrect shipment, faulty or damaged goods on delivery, must be made within five working days of receipt of goods.
   5. Goods will be accepted for credit or replacement at the sole discretion of the management of Livingstone International.
2. Collection of Goods
   1. Livingstone International Pty Ltd will arrange for goods to be collected, unless otherwise agreed in writing.
   2. If the goods have been returned without any written authorisation by Livingstone International Pty Ltd, the company will not be responsible for any charges (for any reason) such as freight, insurance and custom duty etc.
3. Claims for Breakages (Export customers only)
   1. Claims for breakages must be referred to your insurers. We do not insure export consignments.
4. 10% Re-stocking fee
   1. Goods returned due to orders placed incorrectly will be subject to a 10% restocking fee with a minimum fee of $20.00.
5. Issue of Credit
   1. Livingstone International Pty Ltd reserves the right to refuse or delay credit or replacement unless the procedures for the return of goods have been followed.
